1. Agreement to terms

These Terms and Conditions (“Terms”) govern your use of the website at https://fightinghawkboxing.com and the services offered by Magadit Bonse LLC dba Fighting Hawk Boxing (“Fighting Hawk Boxing,” “we,” “us,” or “our”). By creating an account, booking a class, or otherwise using our services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site or services.

2. Eligibility

You must be at least 18 years old to create an account. A parent or legal guardian may register and book on behalf of a minor and is responsible for that minor’s compliance with these Terms, the waiver, and the Code of Conduct.

3. Accounts

You are responsible for the accuracy of the information you provide and for maintaining the confidentiality of your account credentials. You are responsible for activity that occurs under your account. Notify us promptly of any unauthorized use.

4. Bookings, waitlists, and capacity

Classes and sessions are subject to capacity limits, including limits on total attendance and on availability of loaner equipment. Booking a class does not guarantee a spot until confirmed, and waitlisted spots are promoted automatically as capacity allows. We may modify, reschedule, or cancel classes and sessions, and we will notify you of changes affecting your bookings.

5. Memberships, payments, and cancellations

• Memberships and drop-in sessions are billed through our payment processor, Stripe. By purchasing, you authorize the applicable charges.
• Recurring memberships renew automatically until cancelled. You may manage or cancel your subscription through the customer portal or by contacting us.
• Drop-in sessions are non-refundable once purchased. You may cancel a recurring membership at any time; cancellation takes effect at the end of your current paid billing period, you keep access through the end of that period, and we do not provide prorated refunds for the remainder of it.
• Prices and offerings may change; changes apply to future billing periods.

6. Waiver, assumption of risk, and Code of Conduct

Boxing and fitness training involve inherent risks of physical injury. Participation requires acceptance of our waiver and release and our Code of Conduct, which are presented separately and incorporated into these Terms by reference. You agree to follow all gym rules and staff instructions. We may suspend or terminate access for conduct that violates the Code of Conduct or endangers others.

7. Text messaging

Our SMS program is described in Section 4 of the Privacy Policy. By opting in, you agree to receive a text message when new classes are scheduled. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help.

8. Acceptable use

You agree not to misuse the Site or services, including by attempting to gain unauthorized access, interfering with the platform’s operation, submitting false information, or using the services for any unlawful purpose.

9. Intellectual property

The Site and its content, including the Fighting Hawk Boxing name, logo, and branding, are owned by Magadit Bonse LLC or its licensors and are protected by law. You may not use them without our prior written permission.

10. Third-party services and links

Our services rely on third-party providers (including Twilio, Stripe, and Google). Text messages we send link only to our own Site. We are not responsible for the content or practices of any third-party websites or services not operated by us.

11. Disclaimers

The Site and services are provided “as is” and “as available” without warranties of any kind, whether express or implied, to the fullest extent permitted by law, including any warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be uninterrupted or error-free.

12. Limitation of liability

To the fullest extent permitted by law, Magadit Bonse LLC and its members, managers, employees, and instructors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or relating to your use of the Site or services. This section does not limit liability that cannot be limited under applicable law, and is in addition to — not in place of — the separately signed waiver and release.

13. Indemnification

You agree to indemnify and hold harmless Magadit Bonse LLC and its members, managers, employees, and instructors from claims and expenses arising out of your use of the services, your violation of these Terms, or your violation of any rights of another.

14. Governing law and disputes

These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the services will be resolved in the state or federal courts located in Jackson County, Missouri, and you consent to their jurisdiction.

15. Changes to these terms

We may update these Terms from time to time. We will post the updated version with a new “Last updated” date, and continued use of the services after changes take effect constitutes acceptance.
